2. Personal data collected
Depending on the services used, the following categories of data may be collected:
- identity and contact details: last name, first name, e-mail address and phone number;
- delivery and billing addresses;
- data needed to create, secure and manage the customer account;
- data relating to orders, payments, deliveries, returns and refunds;
- purchase history and exchanges with customer service;
- the content of messages sent via the contact form;
- technical data: IP address, connection logs, session data, browser and information needed for the security of the website;
- choices made regarding cookies and other trackers.
As the website is dedicated to adult products, purchase history may reveal particularly intimate information. RUBBER K therefore applies a principle of strict confidentiality, limits access to authorised persons and does not reuse this information for purposes incompatible with the management of the commercial relationship.
RUBBER K does not store full payment card data. It is transmitted directly to the secure payment provider chosen for the order. The identity of this provider is communicated to the customer at the time of payment, and this policy will be updated as soon as the final solution has been selected.
3. Purposes and legal bases
Personal data is used for the following purposes:
- management of the account, basket and orders: performance of the contract or pre-contractual measures;
- payment, delivery, returns, refunds and after-sales service: performance of the contract;
- responding to contact requests: pre-contractual measures or legitimate interest in responding to requests;
- invoicing and accounting or tax obligations: compliance with legal obligations;
- fraud prevention, securing the website and defending rights: legitimate interest of RUBBER K;
- marketing or newsletter, if this service is enabled: consent where required, with the possibility of withdrawal at any time;
- audience measurement or non-essential advertising: prior consent to the storage or reading of the trackers concerned.
4. Mandatory nature of the information
The fields marked as mandatory are necessary to create an account, prepare an order, deliver it or process a request. Without this information, the service concerned cannot be provided. The other fields are optional.
5. Recipients and processors
The data is accessible only to RUBBER K, to duly authorised persons and to the providers who need it to carry out their task, in particular:
- Infomaniak Network SA, for hosting and technical services;
- the secure payment provider selected at the time of the order;
- Boxtal and the chosen carrier, for organising and carrying out the delivery;
- the internal services used to send transactional e-mails;
- technical, accounting, legal or maintenance providers, strictly within the limits of their tasks.
The data is neither sold nor rented. Providers may only use it for the services requested and must comply with their confidentiality and security obligations.
6. Transfers outside the European Economic Area
Where a provider involves a transfer of data outside the European Economic Area, RUBBER K checks that this transfer is based on a mechanism recognised by the applicable regulations and that appropriate safeguards are in place. Information about the providers concerned will be specified here when they are activated.
7. Retention periods
- Customer account: for the duration of its use, then up to three years after the last activity, unless a legal obligation applies or a deletion request compatible with RUBBER K's obligations is made.
- Orders and commercial relationship: for the time needed to fulfil the order and provide after-sales service, then in intermediate archiving for the applicable legal periods.
- Invoices and accounting records: ten years in accordance with accounting obligations.
- Contracts and commercial correspondence: for the applicable legal period, generally five years, subject to any specific period imposed by law.
- Contact requests: for the time needed to handle them, then a maximum of three years after the last exchange where retention remains justified.
- Marketing data: a maximum of three years after the last active contact or until consent is withdrawn where it forms the basis of the processing.
- Technical and security logs: for a period proportionate to the security purpose, in principle a maximum of twelve months, except in the event of an incident or a specific obligation.
- Cookie choices: in principle six months before a new choice is requested.
On expiry of these periods, the data is deleted or placed in restricted-access archiving where a legal obligation or the defence of rights so requires.
8. Cookies and similar technologies
The website uses cookies or storage mechanisms that are strictly necessary for it to operate, in particular for the session, the basket, form security and remembering the age confirmation. These mechanisms do not require consent when they are essential to the service requested, but they are described to the visitor.
At the date this policy was updated, Google Analytics and Meta Pixel are not enabled. If they are added, they will be blocked until the visitor has given consent. Refusal will be as simple as acceptance, and consent may be withdrawn at any time via the "Manage my cookies" link on the website.
9. Rights of individuals
Under the conditions provided for by the regulations, you may request:
- access to your personal data;
- its rectification where it is inaccurate or incomplete;
- its erasure where the legal conditions are met;
- the restriction of its processing;
- the portability of the data provided, where this right applies;
- your objection to processing based on legitimate interest;
- the withdrawal of your consent at any time, without affecting earlier processing;
- the definition of instructions concerning the fate of your data after your death, in accordance with French law.
To exercise your rights, contact: info@oseleplaisir.com or write to RUBBER K, 2484 route de l’Éculaz, 74930 Reignier, France.
Proof of identity will only be requested in the event of reasonable doubt about the identity of the person making the request. RUBBER K responds in principle within one month, which may be extended in the cases provided for by the regulations.
You may also lodge a complaint with a supervisory authority, in particular the French data protection authority Commission nationale de l’informatique et des libertés (CNIL) or the supervisory authority for your place of residence.
10. Security and confidentiality
RUBBER K implements appropriate technical and organisational measures to protect the data against unauthorised access, loss, alteration, disclosure or destruction. Access to order data and purchase history is limited to persons who strictly need it to manage the shop.
11. Protection of minors
The website and its products are reserved for adults. RUBBER K does not knowingly seek to collect data concerning minors. Any collection brought to its attention may be deleted, subject to the applicable legal obligations.
12. Changes to the policy
This policy may be updated to reflect changes to the website, providers, processing operations or regulations. The version published on this page is the one applicable at the time it is consulted.
