Terms and conditions of sale

1. Purpose and scope
These terms and conditions of sale (the “Terms”) govern all sales of products concluded on the website www.oseleplaisir.com (the “Site”) between RUBBER K, sole trader (the “Seller”), and any adult natural person acting for purposes outside their trade, business or profession (the “Customer”).
Placing an order implies unreserved acceptance of these Terms, which the Customer acknowledges having read before confirming the order. The applicable Terms are those in force on the date of the order. The Seller may amend them for the future; amended Terms apply only to orders placed after they are published.

3. Products
The products offered for sale are those shown on the Site on the day it is consulted, subject to available stock. They are described as accurately as possible; photographs and visuals are not contractual, and slight variations (colour, dimensions) may exist.
The Site presents and sells products intended exclusively for adults. By placing an order, the Customer declares that they are at least 18 years old and have the legal capacity to contract.
If a product is unavailable after the order, the Customer is informed as soon as possible and may obtain a refund of the corresponding amount within fourteen (14) days.
4. Prices
Prices are shown in euros, inclusive of all taxes, excluding delivery costs. Delivery costs are calculated and displayed before the order is finally confirmed.
The applicable price is the one shown on the Site when the order is confirmed. For deliveries outside the European Union, customs duties, import taxes or handling fees may be charged by the authorities of the destination country and are payable by the Customer.
5. Orders
The Customer selects the products, adds them to the basket, enters their contact and delivery details, chooses a delivery method and proceeds to payment. Before confirmation, the Customer can review the order and correct any input errors.
Confirming the order, after acceptance of the Terms and payment, forms the contract of sale. The Seller confirms the order by a summary e-mail. The Seller may refuse or cancel any order from a Customer with whom there is a dispute regarding payment of a previous order, or in the event of a manifestly abnormal or bad-faith order.
The data recorded by the Seller constitutes proof of the order and transactions. The Seller archives contracts in accordance with the applicable regulations and gives the Customer access on request.
6. Payment
Payment is made online using the means offered on the payment page. The secure payment provider is indicated to the Customer at the time of payment; the Seller does not store full payment card data.
The order is processed only after the payment has actually been received. The products remain the property of the Seller until the price is paid in full; the transfer of risk nevertheless takes place on physical delivery of the products to the Customer in accordance with clause 7. In the event of failed or refused payment, the order is automatically cancelled.
7. Delivery
Delivery areas, costs, times and receipt terms are detailed on the Shipping and returns page, which forms an integral part of these Terms.
Unless otherwise stated, delivery takes place without undue delay and no later than thirty (30) days after the conclusion of the contract. The risk of loss of or damage to the products passes to the Customer when they, or a third party designated by them other than the carrier, take physical possession of the products.
8. Right of withdrawal
The Customer has a period of fourteen (14) days to exercise their right of withdrawal, under the conditions detailed on the Shipping and returns page, which contains the full information notice and the model withdrawal form.
The right of withdrawal does not apply, in particular, to goods unsealed by the Customer after delivery which cannot be returned for reasons of hygiene or health protection, which concerns most of the intimate products sold on the Site.
9. Legal guarantees
The Customer benefits from the statutory guarantee of conformity and the guarantee against hidden defects, independently of any commercial warranty. The terms for invoking them are set out on the Shipping and returns page.
10. Liability
The Seller cannot be held liable for misuse of the products, use that does not comply with their intended purpose or with the instructions for use, or for damage resulting from the act of a third party or of the Customer. The products must be used in accordance with the instructions and warnings provided. The Seller cannot be held liable for non-performance of the contract in the event of force majeure or any event beyond its control.
11. Personal data
The processing of the Customer's personal data is described in the privacy policy.
12. Intellectual property
All elements of the Site (texts, visuals, logos, trademarks, layouts) are protected by intellectual property law and remain the property of the Seller or its partners. Any reproduction or use without prior written authorisation is prohibited.
13. Complaints and customer service
For any complaint, the Customer may contact customer service at info@oseleplaisir.com or in writing at the Seller's address given in clause 2, stating their order number.
14. Consumer mediation
Under the applicable French rules, a consumer Customer has the right to use a consumer mediator free of charge to seek an amicable resolution of a dispute with the Seller, after a prior written complaint that has not received a satisfactory response.

15. Governing law and disputes
These Terms and the contracts of sale are governed by French law. Mandatory provisions more protective of the consumer Customer under the law of their country of habitual residence within the European Union remain applicable. Failing an amicable resolution, disputes fall within the jurisdiction of the French courts under ordinary law; the consumer Customer may also bring proceedings in the courts of their place of residence.
16. Language of the contract
These Terms are drafted in French. Where translated into another language, only the French version prevails in the event of a dispute concerning their interpretation.
